These Terms and Conditions govern your use of bestspainbeaches.com (the “Site”). By accessing or using the Site you agree to be bound by them. If you do not agree, please stop using the Site.

These Terms sit alongside our Legal Notice, Privacy Policy, Cookies Policy and Disclaimer, which together set out the basis on which we publish. Where the Legal Notice covers the same ground in less detail, these Terms expand on it rather than replace it.

1. Who Operates This Site

Best Spain Beaches is an independent editorial site about the beaches and coves of the Spanish coast. It is published under the editorial name “Esther Luna”, a declared pen name used by an individual editor based in Spain — see our About the Author page. Full legal identification, including tax identification number and registered postal address, is available on request by writing to bestspainbeaches@gmail.com.

2. Permitted Use

You may read, print and share our content for personal, non-commercial purposes. You may link to any page on this Site from your own website or social media without asking permission, provided you link to the original URL and do not present our work as your own.

You may quote briefly from our articles in educational or journalistic contexts, with clear attribution and a working link back to the source page.

3. Prohibited Use

When using this Site, you agree that you will not:

  • Use the Site for any unlawful purpose, or in any way that infringes the rights of others.
  • Republish, sell, licence or otherwise commercially exploit our editorial content without prior written permission.
  • Use bots, scrapers or other automated tools to extract content, other than legitimate search engine indexing carried out in accordance with our robots.txt file.
  • Attempt to gain unauthorised access to the Site, its hosting environment or any connected system, or interfere with its normal operation.
  • Introduce malicious code, or use the Site in a way that could damage or overload it.
  • Misrepresent your identity or your affiliation with any person or organisation when contacting us.

We may suspend or deny access to anyone who breaches these Terms.

4. Intellectual Property

The editorial content of this Site — the written text of our beach guides and rankings, their structure, and the design of the Site — is original work and remains our property under Spanish and international copyright law.

Photographs are a separate matter. All images used on this Site are published under Creative Commons licences or as public domain material, sourced from Wikimedia Commons, and they remain the property of their respective photographers. The photographer and the licence are credited on the page where each image appears, and full attribution including a link to the source file appears in the individual beach guide the photograph illustrates. We claim no ownership over third-party photographic material, and nothing on this Site should be taken as granting you rights over it: if you wish to reuse a photograph, you must comply with its own licence terms.

If you are a rights holder and believe material has been used without proper authorisation or attribution, the takedown procedure is set out in section 5 of our Legal Notice.

5. Accuracy of Content and No Warranty

We research carefully and correct errors when we find them, but the Site is provided “as is” and “as available”. We give no warranty, express or implied, that the content is complete, accurate or current, or that the Site will be free of interruption or error.

Beach access rules, parking arrangements, fees, lifeguard seasons and municipal ordinances on the Spanish coast change frequently and sometimes without notice. Our Disclaimer explains in full what this means for you before you travel, and it forms part of these Terms.

6. Limitation of Liability

To the fullest extent permitted by law, we accept no liability for any loss or damage arising from your use of, or reliance on, the content of this Site, including decisions taken about where and when to travel or swim. Any action you take on the basis of what you read here is taken at your own risk.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.

7. Third-Party Links

Our articles link to external sources — town halls, natural park authorities, regional tourism registers, official gazettes and similar. These links are provided because we want you to be able to check what we say against the source. We do not control those websites, are not responsible for their content or availability, and their inclusion is not an endorsement.

8. Advertising and Commercial Independence

This Site may display advertising served by third-party advertising networks, including Google AdSense. Where advertising is active, ads may be personalised, and you can manage that through the consent controls on this Site and through your Google account settings. We do not select individual advertisements and do not endorse the products or services advertised.

Advertising is kept strictly separate from editorial judgement. We do not publish sponsored content, paid placements, paid rankings or affiliate links, and no business mentioned in our guides has paid to appear or influenced its position in any ranking. If that ever changes, it will be disclosed clearly at the beginning of the relevant post.

9. Privacy and Cookies

How we handle personal data, and the legal bases on which we do so, is set out in our Privacy Policy. How cookies are used, and how to accept or reject non-essential ones, is set out in our Cookies Policy. Non-essential cookies are only placed after you give explicit consent through the banner, and you can change that choice at any time.

10. Messages You Send Us

If you write to us through the contact form or by email, please do not send confidential or sensitive personal information. Corrections, factual challenges and rights-holder notices are welcome and we read all of them. We may act on a factual correction by amending an article, without any obligation to publish your message or to reply.

11. Changes to These Terms

We may update these Terms from time to time. The current version is always the one published on this page, with a revised “Last Updated” date at the top. Continuing to use the Site after a change means you accept the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the law of the Kingdom of Spain. Disputes that cannot be resolved amicably shall be submitted to the Spanish courts.

If you are a consumer resident in the European Union, this does not deprive you of the protection afforded by the mandatory provisions of the law of your country of residence, nor of any right you may have to bring proceedings before the courts of that country.
